  • First Time DWI: First time DWIs are the most common types to get dismissals.  If there was no BAC test, or if BAC was under 0.15 the chances are a bit better.  This also depends by county, as some counties are much more leniant than others when it comes to first time offenders.  However, it is never a given - you should still hire an attorney to ensure you have the best chances possible.
  • Second Time DWI: These are harder to get dismissed but still possible. You need an attorney to review the details of the case and build a strong defense.
  • Third Time DWI: If it's your 3rd DWI or more, you are risking prison time and a felony conviction.  You need an attorney to fight your case for you.
